Waiver of Liability, Acceptance of Policies, and Hold Harmless Agreement — Seaside Shadows Haunted History Tours (CT & RI)

Must Read Before Purchase — Applies to All Seaside Shadows Haunted History Tours in Connecticut & Rhode Island

Every participant must read and agree to this waiver before the start of the tour. Your participation confirms that you assume all risks and hazards associated with the walk for yourself and any minor children in your care.

Assumption of Risk & Release of Liability

1. Voluntary Participation — I voluntarily participate in the Seaside Shadows Haunted History Tour, understanding it may involve hazards including but not limited to: uneven or slippery sidewalks, cobblestones, cemetery terrain, road crossings, low lighting, inclement weather, paranormal investigation equipment, and conduct of other participants. I accept all risks, known and unknown, including serious injury, property damage, or death.

2. Release of Liability — I RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Seaside Shadows Haunted History Tours, its owners, employees, contractors, volunteers, property partners, and the municipalities of Mystic, Stonington, Groton, and Westerly, as well as Elm Grove Cemetery Association (RELEASEES) from all claims or demands arising from my participation, whether caused by the negligence of RELEASEES or otherwise.

3. Indemnification — I agree to INDEMNIFY AND HOLD HARMLESS the RELEASEES from any liability, damage, or costs (including attorney fees) resulting from my participation or that of any minors in my care.

4. Binding Effect — This waiver binds my heirs, assigns, personal representatives, and anyone else who may claim on my behalf.

5. Medical & Physical Conditions — I affirm that I am in good health and able to safely participate. I have disclosed any relevant health conditions or mobility limitations.

6. Weather & Itinerary Changes — I understand tours run rain or shine and that itineraries may be changed or shortened for safety or comfort without refund.

7. Personal Conduct — I will remain respectful, follow the guide’s instructions, obey all laws, and avoid disruptive behavior. Alcohol, drugs, firearms, explosives, smoking, and disorderly conduct are strictly prohibited.

8. Children — Any minors under my care will be supervised at all times and must follow all rules.

9. Private Property & Neighbors — I will not trespass, block sidewalks, or cause disturbances in residential or business areas.

10. Photography & Media — I grant Seaside Shadows permission to use photographs, video, and audio of me taken during the tour for marketing without compensation.

11. Personal Property — I acknowledge that Seaside Shadows is not responsible for lost, stolen, or damaged personal items.

Additional Acknowledgments

1. Inherent Risks — I understand the nature of the activity includes potential exposure to paranormal themes and experiences. I will not hold Seaside Shadows responsible for any haunting, supernatural event, or otherworldly phenomena experienced before, during, or after the tour.

2. Evacuation or Termination — The guide may alter or terminate the tour for safety, security, or behavioral reasons without refund.

3. Finality of Ticket Sales — All ticket sales are final except when Seaside Shadows cancels the tour. Tickets purchased through third-party online travel agencies (OTAs) such as Tripadvisor/Viator, Groupon, Booking.com, GetYourGuide, Expedia, Airbnb, and any others not listed are subject to the same waiver and policies, and by purchasing through these platforms, the buyer agrees to this waiver in full.

4. Governing Law & Venue — This agreement is governed by the laws of the State of Connecticut, and any disputes will be resolved exclusively in the state or federal courts located in New London County, CT.

5. Severability — If any part of this agreement is found invalid, the remaining provisions shall remain in full force and effect.

Supplemental Provisions (Retained from Original Policies)

1. I acknowledge the requirement to obey all traffic laws and remain vigilant when crossing streets.

2. I acknowledge that participation may expose me to hazards including difficult weather, impact or collision with other persons, becoming lost or separated, or negligence of others, including the RELEASEES.

3. I acknowledge that Seaside Shadows may remove participants showing signs of intoxication or disorderly behavior without refund, and that such behavior may result in arrest.

4. I acknowledge responsibility for minors in my care and their adherence to all policies.

5. I acknowledge that no oral representations, statements, or inducements apart from this written agreement have been made.

SIGNATURE INSTRUCTIONS: This waiver must be signed by each adult participant (18 years or older) in their own name. A parent or legal guardian must sign on behalf of any participating minors under the age of 18, and by doing so accepts full responsibility for their safety and conduct during the tour.

ONLINE ACCEPTANCE CHECKBOX LANGUAGE (Legally Binding): By checking this box, I affirm that I have read, understood, and agree to the Waiver of Liability, Acceptance of Policies, and Hold Harmless Agreement for Seaside Shadows Haunted History Tours. I acknowledge that this agreement is legally binding upon me, my heirs, executors, administrators, and assigns, and that I am at least 18 years of age or the parent/guardian of participating minors, agreeing on their behalf.
